Ask a specialist

What is cargo insurance and what does it cover?

Cargo insurance covers loss of or damage to goods while they are transported by road, sea, air or rail. The scope depends on the clauses chosen: Institute Cargo Clauses ICC (A) cover all risks except listed exclusions, while ICC (B) and ICC (C) cover named perils only. Loading, transhipment, interim storage and unloading can also be included.

What is the difference between ICC (A), ICC (B) and ICC (C)?

ICC (A) is the widest cover and includes risks such as theft, breakage and wetting, excluding only what the policy explicitly excludes. ICC (B) covers named perils such as fire, explosion, sinking or overturning of the conveyance, collision, earthquake, lightning and total loss of a package dropped during loading or unloading. ICC (C) is limited to a narrower list including fire, explosion, sinking, stranding, collision and general average.

Is CMR insurance the same as cargo insurance?

No. CMR insurance covers the international road carrier's legal liability under the CMR Convention, and compensation is limited to 8.33 SDR per kilogram of gross weight. Cargo insurance protects the cargo owner directly and pays based on the invoice value. Because the CMR limit may be insufficient for high-value goods, cargo owners are advised to buy their own cargo insurance.

Under Incoterms, who should buy cargo insurance?

It depends on the delivery term in the sales contract. Under CIF and CIP the seller must insure the goods; Incoterms 2020 requires at least ICC (C) for CIF and ICC (A) for CIP. Under terms such as EXW, FCA and FOB the risk passes to the buyer early, so the buyer is advised to arrange their own cargo insurance.

Who needs Freight Forwarder Liability (FFL) insurance?

FFL insurance covers the professional and legal liabilities that freight forwarders and logistics companies assume towards their customers. Key covers include cargo loss or damage, incorrect or missing documents, misdelivery and resulting financial loss. It is critical for forwarders issuing their own bills of lading or FBLs.

Per-shipment policy or annual open policy?

For companies with regular imports or exports, an annual open (floating) policy is usually more advantageous: every shipment is declared under one policy, premium terms are agreed in advance and the risk of uninsured shipments is eliminated. For occasional one-off shipments a per-shipment policy may be more suitable.

What should I do in case of a cargo claim?

As soon as you notice the damage, note your reservations on the delivery documents, photograph the damaged goods and packaging, notify the carrier in writing and inform us as soon as possible. The Kum Sigorta team follows the process on your behalf, from notifying the insurer to surveyor appointment and settlement.
